About DirectHome Kenya
DirectHome Kenya is a property marketplace focused on properties and users in Kenya. It provides technology for property discovery, listings, messaging, controlled location sharing and related services.
DirectHome Kenya is not the property owner, landlord, seller, buyer, tenant, estate agent acting for either party, party to a tenancy or sale agreement, legal conveyancer, property valuer, surveyor or title-verification authority.
Operator information
DirectHome Kenya is operated from the United Kingdom by Dariusz Debowski trading as Smart AI Lab. An official UK business correspondence address will be displayed where legally required before paid commercial services are activated. A private residential address is not published.
Acceptance and versioned consent
Users must actively accept these Terms and the Privacy Policy. Acceptance is not inferred from silence or a pre-selected checkbox. The platform stores a versioned record containing document type, version, date and time, acceptance or withdrawal action, and relevant security metadata where appropriate.
Material changes are presented for review and renewed acceptance where necessary. A user who declines required updated Terms can be restricted from new activity while retaining lawful account-management options such as data access and deletion requests.
Privacy Policy
The Privacy Policy explains how personal information, location data, messages, verification and security records are handled and forms part of the agreement governing use of the platform.
Eligibility and age requirements
Users must be at least 18 years old to create a property transaction account, publish an advertisement, request or purchase paid services, or enter platform-related commercial arrangements. Property seekers can browse and contact listers without submitting identity documents.
Owners, agents, developers, companies and other listing publishers must complete identity and age verification. The contracting party remains responsible for checking the identity and legal capacity of a prospective tenant or buyer before signing an agreement.
User accounts and roles
Supported roles are Property Seeker, Property Owner, Agent, Developer / Company and Administrator. Public registration never creates an Administrator. Users must choose an accurate role and keep account and contact information current.
- Seekers must make genuine enquiries and respect access decisions.
- Owners and landlords must have authority to advertise and provide accurate information.
- Agents must have genuine authority for every represented property.
- Developers and companies must act through authorised representatives and accurately describe projects and availability.
Account security
Users are responsible for a strong password, protected devices, confidential credentials, accurate contact information, prompt compromise reports and review of active sessions. The platform can revoke sessions, require re-authentication or restrict access when compromise is suspected.
- Never send passwords or authentication codes.
- Never send M-Pesa PINs or bank login credentials.
- Never send full payment credentials.
Identity verification for listers
A publisher can be required to submit an accepted identity document to verify identity, name, age 18+, validity and account eligibility. The full document image is retained no longer than 30 days after completion and is then permanently deleted; a limited audit record can remain under the Privacy Policy.
Verification can be rejected or suspended for false, inconsistent, expired, manipulated or insufficient information. It does not prove property ownership, title, authority, absence of disputes or the legal validity of a transaction.
Property listing rules
Every listing must be genuine, current, accurate, lawful, authorised, connected to a real property and supported by suitable information and images. The publisher must have lawful authority to advertise it and promptly update or remove it when unavailable.
- No false availability, fake prices or misleading descriptions.
- No stolen photos or copied content without permission.
- No unlawful discrimination, fraudulent payment requests or malicious links.
- No duplicate listings intended to manipulate ranking.
- No contact details intended to bypass platform controls.
- No exact GPS coordinates in public text or images.
Listing status, review and approval
A listing can be draft, pending review, published, rejected, temporarily hidden, suspended, expired, archived or removed. Submission does not guarantee publication. DirectHome Kenya can review compliance, safety, completeness and apparent authenticity.
Approval is not ownership or title verification, legal due diligence, structural inspection, valuation, endorsement or transaction guarantee.
Photos and uploaded content
Users must have authority to upload every photo, description and document. Files must not infringe intellectual property, privacy or other rights, contain malicious material or reveal private exact coordinates. Technical file and image requirements can be enforced.
GPS location and physical presence
Publication requires an exact map pin, coordinates, GPS accuracy, timestamp, live device-location capture and a presence check near the property. The publisher must be physically present. Publication can be blocked when permission is denied, accuracy is insufficient, distance is too great or signals appear inconsistent or manipulated. A configurable distance threshold accounts for normal GPS variation.
GPS confirms only that the device and user appeared near the location. It does not establish ownership, title, authority, lawful possession, right to rent or sell, condition or absence of disputes. GPS spoofing is prohibited.
Approximate public location
Exact coordinates are private by default. Public users can see county, town, area or estate, nearest landmark and an approximate map area. DirectHome Kenya can offset or generalise a public pin. Users must not derive, scrape or expose private coordinates without permission.
Exact-location request and approval
A registered user can request exact location through internal messaging. The authorised lister can approve, decline or revoke it. Approval is personal, account-specific, non-transferable, non-assignable, limited to one property and requester, and valid for 48 hours.
The requester must not transfer approval, share account access, publish the location or use another account to evade refusal or expiry. Each person needs a separate request. Approved users can view the map and Get Directions without unnecessary raw coordinates. Request, approval, refusal, activation, expiry and revocation are logged.
Contact-detail request and approval
Owner, landlord and agent telephone and WhatsApp details are private by default. Initial contact occurs through internal messaging. A lister can approve or decline access for a specific account. Approval is personal, logged where appropriate, revocable and does not make details public. Private details must not be republished without permission.
Internal messaging and attachments
Messaging supports listing questions, viewing arrangements, access requests, property information, supporting photographs and permitted documents. DirectHome Kenya can access and preserve messages where reasonably necessary for reports, security, moderation, fraud prevention, legal compliance or disputes.
Supported property-image formats and PDF documents can be attached, subject to type and size limits, safe filenames, access controls and security checks where available.
- No harassment, threats, impersonation, fraud, spam or discrimination.
- No illegal activity, malicious files or credential requests.
- Do not upload unnecessary identity documents or financial credentials.
Property viewings and safety
Users arrange viewings directly and at their own risk. DirectHome Kenya does not supervise viewings unless a separate written service expressly states otherwise.
- Confirm the other person's identity and role.
- Confirm time and place and tell a trusted person.
- Consider attending with another person.
- Avoid carrying large amounts of cash or paying before appropriate checks.
- Leave if circumstances appear unsafe.
Maps and Get Directions
Maps can depend on device geolocation, browsers, external mapping applications and navigation providers. Routes, estimates and map data can be incomplete, inaccurate or unavailable. Users remain responsible for road safety, local conditions, lawful access, confirming the meeting point and deciding whether travel is safe.
Reports, temporary hiding and investigation
Users can report listings, accounts, messages, suspected fraud, abuse, harassment, impersonation, misleading information, prohibited content or safety concerns. A serious report can temporarily hide a listing pending review.
The lister receives a case number, reason category, status, reasonable response period and a method to provide evidence. An administrator can restore, require corrections, continue suspension, remove, restrict an account or refer serious matters where legally appropriate. Knowingly false or malicious reports are prohibited.
Fraud prevention
Users must independently verify identity, authority, property documents and payment recipients. Requests for PINs, passwords, unusual advance payments or secrecy should be treated as warning signs and reported. DirectHome Kenya can preserve evidence and restrict activity during a reasonable investigation.
Video Verified listings
Live Video Verification calls are not recorded or stored. No video, audio, screenshots or document copies shown during the call are retained. The system can retain date, time, verifier, outcome, brief notes and expiry.
Verification confirms only apparent live access, visible consistency and specifically recorded checks. It is not ownership or title verification, legal due diligence, conveyancing, survey, structural inspection, valuation, continued-availability confirmation or guarantee against fraud. A badge can expire, be suspended or removed.
Free basic listings
Basic rental and sale listings can have a configured price of KES 0. A zero price means no publication fee for that service at that time. Future charges apply prospectively, must be displayed and expressly accepted, and cannot be imposed retroactively on completed submissions.
Optional paid promotions
Optional services can include Featured Listing, Top Listing, Homepage Featured, Urgent Badge and Listing Boost. Before purchase, checkout displays the name, exact KES price, duration, activation, placement benefit, expiry and refund or cancellation conditions.
Promotion purchases only the stated visibility treatment. It does not guarantee impressions, external ranking, enquiries, messages, viewings, rental, sale, price or return on investment.
Prices, payment and activation
Payment options are available only when displayed as active at checkout. When payment is unavailable, no paid service can be purchased and no payment contract forms. Activated providers can include M-Pesa or Stripe. DirectHome Kenya never requests or stores M-Pesa PINs, online banking passwords or full payment credentials.
Promotion activates only after sufficient payment confirmation. Status can be pending, awaiting confirmation, paid, failed, cancelled, reversed, refunded, expired or manually verified. Reversed, fraudulent or charged-back payment can end promotion and trigger investigation.
Online orders and confirmation
Before confirmation, checkout shows service, property, price, currency, relevant charges, duration, material limits, cancellation and refund terms. Users can review, correct, accept or cancel. The final action clearly indicates a payment obligation.
After successful payment or confirmed order, a durable email, receipt or account record provides reference, service, amount, property, date, duration, status and applicable cancellation information. The checkout terms and Terms version shown at purchase form part of the agreement.
Cancellation and refunds
Checkout states when performance begins. Immediate activation requires an express, non-preselected request and the legally required cancellation information, including the effect of immediate or completed performance.
Refunds can apply to duplicate payment, payment without activation, a technical failure preventing material delivery, cancellation by DirectHome Kenya without user fault, or where law requires. They are normally unavailable solely because there were no enquiries, the user changes their mind after material delivery, the property completes early or expected results are not achieved. Non-waivable statutory rights remain unaffected.
Pricing changes
Future prices and packages can change prospectively. Changes are displayed before purchase, never retroactively increase completed orders, and can be communicated through the platform or email where material.
Listing expiry and removal
Listings can expire automatically or be archived, suspended or removed for unavailability, inaccuracy, policy breach, lawful request, safety, fraud prevention or operational reasons. Users must remove unavailable properties promptly.
User content licence
Users retain ownership of content they lawfully own. Uploading grants DirectHome Kenya a non-exclusive, worldwide, royalty-free licence for the reasonably necessary duration to host, store, resize, compress, reproduce, display, distribute within the platform, promote the listing within DirectHome Kenya, create thumbnails and technical derivatives, moderate and investigate. The licence is limited to operation, security, promotion and improvement of the platform.
Intellectual property
The DirectHome Kenya name, logo, branding, source code, original interface, text, graphics, protected database structures, compiled datasets and documentation cannot be copied, scraped, resold, reproduced or misrepresented except by law or written permission. Normal sharing of individual listing links is allowed.
Prohibited technical conduct
Users must not scrape without permission, harvest data, attack credentials, bypass controls, discover private coordinates, exploit vulnerabilities, upload malware, conduct denial-of-service activity, reverse engineer except where law permits, create fake accounts, manipulate ranking, evade suspension or access another user's data.
Third-party services
Independent services can include maps, navigation, payment providers, email infrastructure, consented analytics and external links. Their terms and privacy notices apply. DirectHome Kenya is not responsible for independent services but remains responsible for its own legal obligations and provider selection.
Platform availability and changes
The platform can be interrupted for maintenance, upgrades, security, hosting, connectivity, emergencies or events outside reasonable control. Continuous service is not guaranteed, but reasonable restoration steps are taken. Features can change for security, legal, operational or user-protection reasons.
No professional advice
Platform content is general information, not legal, financial, tax, valuation, surveying, conveyancing or investment advice. Users should obtain independent professional advice where appropriate.
User-to-user transactions
Tenancy, sale, agency, viewing and related agreements are directly between users. DirectHome Kenya does not hold deposits, rent, sale proceeds or purchase money unless a separate future service expressly says otherwise.
Users must verify identity, authority, ownership or title, legal documents, land records, condition, planning status, debts or charges, contract terms and payment recipient.
Disclaimers and liability
DirectHome Kenya does not guarantee user-content accuracy, ownership, title, authority, condition, availability, suitability, transaction completion, viewing safety, uninterrupted operation, map accuracy or promotion results. It takes reasonable care in operating its own systems, moderation and paid services.
Nothing excludes liability for death or personal injury caused by negligence where prohibited, fraud, fraudulent misrepresentation, deliberate misconduct, mandatory liabilities or statutory consumer rights. Subject to mandatory law, DirectHome Kenya is not responsible for losses caused primarily by false user submissions, private agreements, unauthorised adverts, independent third parties, off-platform acts, failure to perform checks or events outside reasonable control. No arbitrary financial cap is imposed.
Limited business-user indemnity
Business users, agents, developers and companies are responsible for reasonable losses arising directly from listings they had no right to publish, intellectual-property infringement, fraudulent content, deliberate breach or unlawful use. This is not a broad consumer indemnity and applies only to the extent fair and lawful.
Suspension and termination
Accounts can be restricted, suspended or terminated for security, fraud prevention, repeated breaches, unlawful conduct, false verification, payment abuse, harassment, user protection or legal compliance. Where appropriate, users receive a reason category, status and review or appeal path. Immediate restriction can occur where delay creates safety, fraud or security risk.
Automated account deletion and data retention
Deletion requires re-authentication. The system checks active disputes, investigations, unpaid obligations, promotions, legal holds and justified retention needs. Without a blocker, new activity is restricted, deletion or anonymisation is scheduled after 30 days and the user is notified. With a blocker, the reason is explained and the exceptional case goes to an administrator, who cannot arbitrarily refuse a valid request.
Minimal information can be retained under the Privacy Policy and applicable law. Messages, files, verification, investigations, payments and backups follow the retention rules stated in the Privacy Policy.
Changes to these Terms
Terms can change for law, security, new features, payment activation, operations or user protection. Material updates receive a new version and date, are communicated appropriately, do not retroactively alter completed paid orders unless legally necessary, and require renewed acceptance where appropriate.
Governing law
These Terms and operation of DirectHome Kenya are governed by the laws of England and Wales, subject to mandatory rights and protections applying to users in Kenya or another relevant jurisdiction.
Disputes and complaints
Before court proceedings, users should contact DirectHome Kenya and allow a reasonable opportunity to respond. Platform complaints use the Contact page; privacy matters use privacy@directhomekenya.com; payment complaints should include the transaction reference; moderation appeals should include the case number.
DirectHome Kenya will activate the privacy mailbox before public launch. Users retain mandatory court, regulatory and consumer rights. No mandatory paid arbitration applies. Unresolved disputes can be brought before a court or authority with lawful jurisdiction, and users can complain to an applicable competent regulator.
